Amibe Website Builder

Service offered

  1. The Amibe Website Builder is a ‘managed service‘, offered for the making and hosting of Internet websites (‘Amibe Sites‘).
  2. The page located at https://amibe.net/legal/terms-and-conditions/ should be referred to as the current terms and conditions for using the managed service.
  3. The managed service is offered as is with no warranties or guarantees made unless otherwise expressed in these terms and conditions.
  4. The provider of the managed service manages and maintains availability of the managed service, including availability and access, via the Internet, for:
    1. website visitors to view Amibe Sites, and
    2. account holders and their website users to use the managed service for engaging with, making, maintaining or administering Amibe Sites as per their user role.
  5. The provider reserves the right to restrict or limit use of the managed service.
  6. Use of the managed service requires that its use complies with all applicable laws and regulations, and does not infringe on the rights of any third party.

Service fee

  1. Limited use of the managed service for evaluation purposes is provided free of charge for any demo Amibe Sites registered, for a period of up to 14 days from the date of registration (‘evaluation period‘).
  2. With the exception of the evaluation period, a ‘subscription‘ payment for use of the service is required for each Amibe Site in advance, either monthly or yearly (‘the period‘).
  3. Use of the managed service is made available once payment is received.
  4. The renewal date for the subscription, from the day of first payment after the date of registration or from the current renewal date, is:
    1. for monthly payments, the same day of the following month, and
    2. for yearly payments, the same day of the following year.
  5. Subscription payments for continued use of the managed service must be received prior to the renewal date.
  6. Payment is required in US Dollars (USD).

Expiry, cancellation and refunds

  1. The provision of the managed service for an Amibe Site ends once the evaluation period or renewal date is reached (‘expiry‘), unless a subscription payment has been received to extend the service for that Amibe Site.
  2. The subscription for monthly payments cannot be cancelled, will not be refunded, and provided no additional subscription payment is received to extend the service, expire once the period paid for has been completed.
  3. The subscription for yearly payments can be cancelled at any time (‘cancellation‘).
  4. Refunds for cancellation are calculated on a prorate basis of the amount paid for the period less 40% up until the date of cancellation.
  5. Upon expiry or cancellation of the subscription the applicable Amibe Site will be scheduled for deletion for a period of up to 14 days from the date of expiry or cancellation.
  6. While scheduled for deletion the Amibe Site will be:
    1. unavailable for access via the Internet by website visitors, and
    2. limited to upgrade, profile editing and data export functionality for account holders and their website users, as per their user role.
  7. Use of the managed service for an Amibe Site is resumed if a subscription payment is received while it is scheduled for deletion.
  8. An Amibe Site that is scheduled for deletion will be deleted after the period of 14 days has passed and no subscription payment to resume the managed service for that website has been received.

Exclusions

  1. The managed service does not include sending or receiving email. Each Amibe Site with a valid subscription can be configured to send email using the services of an external email provider.
  2. The managed service does not include registration or DNS hosting for domain names. Each Amibe Site with a valid subscription can be configured to use a registered domain name for access to the website.

Amendments

  1. The provider of these services may change these terms and conditions at any time and without notice.
